Per exemple, que un cohereu vulgui l\u2019habitatge per ell, que un vulgui vendre i els altres no, que existeixin diferents cohereus que vulguin quedar-se amb l\u2019immoble, que un dels hereus ja resideixi a l\u2019immoble i consideri que com que porta un temps vivint all\u00e0 hi t\u00e9 m\u00e9s dret, etc.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><b>Es pot desallotjar a un hereu d\u2019una casa?<\/b><\/strong><\/p>\n<p>Qui ocupa l\u2019habitatge pot ser propietari d\u2019una part, per\u00f2 aix\u00f2 no li dona dret a utilitzar l\u2019immoble en exclusiva. El que est\u00e0 fent la persona que ocupa l\u2019habitatge \u00e9s privar a la resta dels hereus de disposar lliurement de l\u2019habitatge. Aquesta persona s\u2019extralimita en el seu dret de possessi\u00f3 i origina un dany i perjudici a la resta dels hereus.<\/p>\n<p>Davant d\u2019aquesta situaci\u00f3 als cohereus nom\u00e9s els queda l\u2019opci\u00f3 d\u2019<strong><b>acudir a la via judicial<\/b><\/strong>. No cal que tots es posin d\u2019acord, sin\u00f3 que qualsevol dels cohereus poden instar el procediment judicial que correspongui. Poden donar-se els seg\u00fcents casos:<\/p>\n<p>&nbsp;<\/p>\n<p>\u2776 <strong><b>Habitatge cedit en precari.<\/b><\/strong>\u00a0L\u2019hereu que viu a l\u2019immoble es pot trobar en situaci\u00f3 prec\u00e0ria si no t\u00e9 un t\u00edtol de propietat formal o un acord de lloguer v\u00e0lid. La resta de cohereus podrien demanar la devoluci\u00f3 de la propietat, els cohereus estan en el seu dret d\u2019exercir accions legals que acaben en un desnonament.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2777 <strong><b>Habitatge cedit en comodat.<\/b><\/strong>\u00a0En aquest cas existeix un acord que permet a un dels hereus que pugui utilitzar l\u2019habitatge durant un per\u00edode espec\u00edfic. El seu \u00fas es cedeix de manera gratu\u00efta, no es cobra lloguer. Un cop transcorregut aquest temps, si la persona que est\u00e0 ocupant l\u2019habitatge no el desallotja volunt\u00e0riament, la resta de cohereus estan en el seu dret d\u2019exercir les accions legals per demanar la devoluci\u00f3 de la propietat i el desnonament.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2778 <strong><b>Divisi\u00f3 de una cosa comuna.<\/b><\/strong>\u00a0Quan els cohereus no arriben a un acord sobre com administrar l\u2019immoble del qual en s\u00f3n copropietaris, cada un t\u00e9 dret a demanar en qualsevol moment que es divideixi la cosa comuna. S\u2019ha de demanar al jutjat perqu\u00e8 procedeixi a la dissoluci\u00f3 i determini la part que correspon a cada propietari.<\/p>\n<p>En aquest cas, despr\u00e9s de realitzar una taxaci\u00f3 sobre l\u2019immoble, es pot adjudicar el mateix a un dels hereus havent de compensar econ\u00f2micament a la resta, o procedir a la subhasta de l\u2019immoble i repartir el preu entre els cohereus.<\/p>\n<p>&nbsp;<\/p>\n<p>Si \u00e9s hereu d\u2019un immoble i no existeix conformitat entre els cohereus, el millor \u00e9s que acudeixi a un professional perqu\u00e8 l\u2019assessori de la millor manera possible.
