{"id":567,"date":"2023-08-22T16:14:38","date_gmt":"2023-08-22T16:14:38","guid":{"rendered":"https:\/\/www.aregaymartin.cat\/?p=567"},"modified":"2023-08-22T16:24:28","modified_gmt":"2023-08-22T16:24:28","slug":"tiene-derecho-un-coheredero-a-ocupar-una-vivienda-heredada","status":"publish","type":"post","link":"https:\/\/www.aregaymartin.cat\/index.php\/es\/2023\/08\/22\/tiene-derecho-un-coheredero-a-ocupar-una-vivienda-heredada\/","title":{"rendered":"\u00bfTIENE DERECHO UN COHEREDERO A OCUPAR UNA VIVIENDA HEREDADA?"},"content":{"rendered":"<p>Cuando fallece una persona, los bienes de los que era titular se reparten entre sus <strong><b>herederos.<\/b><\/strong>\u00a0Si el fallecido era titular de una vivienda, \u00e9sta pasa a sus herederos.<\/p>\n<p>Si la vivienda la heredan varios hermanos, pueden surgir problemas ya que puede que no exista acuerdo entre ellos sobre qu\u00e9 hacer con el inmueble.<\/p>\n<p>En el caso de varios herederos, a cada uno le corresponde la <strong><b>parte proporcional<\/b><\/strong>\u00a0de la vivienda porque es un bien indivisible, por ello debe <strong><b>decidirse en com\u00fan<\/b><\/strong>\u00a0sobre la vivienda.<\/p>\n<p>Ante esta circunstancia existen distintas opciones:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Compartir la vivienda entre los herederos y acordar unas normas sobre su utilizaci\u00f3n y manutenci\u00f3n<\/li>\n<li>Que uno de los herederos compre la parte del resto de los herederos<\/li>\n<li>Alquilar la vivienda a un tercero o a uno de los herederos, a cambio de una renta mensual<\/li>\n<li>Vender el inmueble a un tercero y repartirse el precio<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Cuando no exista acuerdo, es posible acudir a la v\u00eda judicial\u00a0para que sea un juez quien decida qu\u00e9 hacer.<\/p>\n<p>Pueden ser varios los motivos por los que los herederos no se pongan de acuerdo. Por ejemplo, que un coheredero quiera\u00a0la vivienda\u00a0para \u00e9l, que uno quiera vender y los otros no, que existan diferentes coherederos que quieran quedarse con la vivienda, que uno de los herederos resida en la vivienda y considere que como lleva tiempo viviendo all\u00ed tiene un mayor derecho, etc.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><b>\u00bfSe puede desalojar a un heredero de un<\/b><\/strong><strong><b>a vivienda<\/b><\/strong><strong><b>?<\/b><\/strong><\/p>\n<p>El que ocupa la vivienda puede ser propietario de una parte, pero eso no le da derecho a usar el inmueble en exclusiva. Lo que est\u00e1 haciendo la persona que ocupa la vivienda es privar al resto de herederos de disponer libremente de la vivienda. Esa persona se extralimita en su derecho de posesi\u00f3n y origina un da\u00f1o y perjuicio al resto de herederos.<\/p>\n<p>Ante esta situaci\u00f3n a los coherederos solo les queda la opci\u00f3n de <strong><b>acudir a la v\u00eda judicial.<\/b><\/strong>\u00a0No hace falta que todos ellos se pongan de acuerdo, si no que cualquiera de los coherederos puede instar el procedimiento judicial que\u00a0corresponda.<\/p>\n<p>&nbsp;<\/p>\n<p>Pueden darse los siguientes casos:<\/p>\n<p>&nbsp;<\/p>\n<p>\u2776 <strong><b>Vivienda cedida en precario.<\/b><\/strong>\u00a0El heredero que vive en la casa puede encontrarse en situaci\u00f3n precaria si no tiene un t\u00edtulo de propiedad formal o un acuerdo de alquiler v\u00e1lido. El resto de herederos podr\u00edan pedir la devoluci\u00f3n de la propiedad, los coherederos est\u00e1n en su derecho de ejercer acciones legales que acaban en desahucio.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2777 <strong><b>Vivienda cedida en comodato. <\/b><\/strong>En este caso existe un acuerdo del resto de herederos, de los propietarios, que permite que uno de los herederos pueda utilizar la vivienda durante un periodo espec\u00edfico. Su uso se dece de forma gratuita, no se cobra alquiler. Transcurrido ese periodo, si la persona que est\u00e1 ocupando la vivienda no la desaloja voluntariamente, el resto de coherederos est\u00e1n en su derecho de ejercer las acciones legales para pedir la devoluci\u00f3n de la propiedad y el desahucio.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2778 <strong><b>Divisi\u00f3n de una cosa com\u00fan. <\/b><\/strong>Cuando los coherederos no llegan a un acuerdo sobre c\u00f3mo administrar la vivienda de la cual son copropietarios, cada uno tiene derecho a solicitar en cualquier momento que se divida la cosa com\u00fan. Se debe solicitar a un juzgado para que proceda con la disoluci\u00f3n de la indivisi\u00f3n y determine la parte que corresponde a cada propietario.<\/p>\n<p>En este caso, tras realizar una tasaci\u00f3n del inmueble, se puede adjudicar el mismo a uno de los herederos debiendo compensar econ\u00f3micamente al resto, o proceder a la subasta de la finca y repartir el precio entre los coherederos.<\/p>\n<p>&nbsp;<\/p>\n<p>Si es heredero de un inmueble y no existe conformidad entre los coherederos, lo mejor es que acuda a un profesional para que le asesore de la mejor manera posible.
