En primer lloc, cal saber qu\u00e8 \u00e9s la potestat parental.<\/p>\n<p>La <strong>potestat parental <\/strong>\u00e9s el conjunt de drets, atribucions i deures que tenen els pares sobre els fills no emancipats. La potestat parental correspon als progenitors amb independ\u00e8ncia de si estan casats entre si o no, ja que es fonamenta en les relacions patern-filials.<\/p>\n<p>Per exemple, algunes decisions que entren dins de l\u2019\u00e0mbit de la potestat parental s\u00f3n:<\/p>\n<ul>\n<li>L\u2019educaci\u00f3 dels fills (elecci\u00f3 inicial o canvi de centre escolar, si el col\u00b7legi ha de ser p\u00fablic i privat, religi\u00f3s o laic)<\/li>\n<li>El canvi de domicili<\/li>\n<li>Autoritzaci\u00f3 per obtenir el passaport o autoritzar un viatge a l\u2019estranger<\/li>\n<li>Q\u00fcestions relatives a la salut (per exemple, decidir si es realitza o no algun tipus d\u2019operaci\u00f3 quir\u00fargica o tractament m\u00e8dic, o decidir si es vacuna al menor)<\/li>\n<li>Realitzaci\u00f3 d\u2019activitats extraescolars o complementaries<\/li>\n<li>Celebracions socials i religioses de rellev\u00e0ncia (per exemple, decidir si es bateja al menor, si realitza o no la primera comuni\u00f3 i similars en altres religions)<\/li>\n<\/ul>\n<p>Aquest tipus de decisions, que s\u00f3n de gran rellev\u00e0ncia en la vida dels fills, <strong>s\u2019han d\u2019adoptar de com\u00fa acord entre ambd\u00f3s progenitors<\/strong>. Ara b\u00e9, aquestes decisions poden ser complicades i els progenitors poden xocar entre s\u00ed. En algunes ocasions, no nom\u00e9s hi ha controv\u00e8rsia entre progenitores separats o divorciats, sin\u00f3 tamb\u00e9 entre parelles casades. <strong>\u00bfQu\u00e8 passa quan apareixen discrep\u00e0ncies entre ambd\u00f3s progenitors a l\u2019hora de prendre certes decisions respecte als seus fills?<\/strong><\/p>\n<p>El m\u00e9s aconsellable \u00e9s intentar arribar a un enteniment per l\u2019inter\u00e8s dels fills. Una via per intentar aconseguir aquest enteniment \u00e9s la <strong>mediaci\u00f3<\/strong>, sobre la que ja en vam tractar en un altre article que pot trobar <a href=\"https:\/\/www.aregaymartin.cat\/index.php\/2021\/01\/02\/la-mediacio-i-els-seus-avantatges\/\">aqu\u00ed.<\/a><\/p>\n<p>No obstant, si no \u00e9s possible arribar a cap acord, l\u2019art. 156 del Codi Civil estableix que, en caso de desacord del progenitors, <strong>qualsevol dels dos podr\u00e0 acudir al jutge<\/strong> qui, despr\u00e9s d\u2019escoltar-los a tots dos i al fill menor d\u2019edat si tingu\u00e9s suficient maduresa i, en tot cas, si fos major de 12 anys, <strong>atribuir\u00e0 la facultat de decidir a un dels dos progenitors. <\/strong>\u00c9s a dir, el jutge no decideix sobre la q\u00fcesti\u00f3, sin\u00f3 que atorga a un dels dos progenitors la potestat de prendre aquesta decisi\u00f3.<\/p>\n<p>Aix\u00f2 es realitza a trav\u00e9s d\u2019un procediment que es denomina <strong>jurisdicci\u00f3 volunt\u00e0ria d\u2019intervenci\u00f3 judicial en casos de desacords en l\u2019exercici de la potestat parental. <\/strong><\/p>\n<p>En aquest procediment intervindr\u00e0 sempre el Ministeri Fiscal que \u00e9s la instituci\u00f3 encarregada de vetllar per la defensa dels interessos dels menors.
