\u00bf<\/strong>Qu\u00e9 es la Ley de Segunda Oportunidad?<\/strong><\/p>\n

El Real Decreto 1\/2015, de mecanismo de Segunda Oportunidad, reducci\u00f3n de cargas financieras y otras medidas de orden social se trata de una ley que protege a los deudores personas f\u00edsicas, ya sean particulares o aut\u00f3nomos.<\/p>\n

El objetivo de la Ley de Segunda Oportunidad es que aquellas personas que hayan pasado por una situaci\u00f3n econ\u00f3mica grave y se encuentren en estado de sobreendeudamiento e insolvencia tengan la posibilidad de cancelar sus deudas, de volver a empezar sin tener que arrastrarlas indefinidamente. En definitiva, que tengan una segunda oportunidad.<\/p>\n

 <\/p>\n

\u00bfQu\u00e9 requisitos deben darse para acceder a la Ley de Segunda Oportunidad?<\/strong><\/p>\n

\u00a0<\/strong>Los requisitos para acceder a la Ley de Segunda Oportunidad son los siguientes:<\/p>\n

 <\/p>\n

– Situaci\u00f3n de insolvencia actual o inminente<\/p>\n

– La cuant\u00eda de las deudas no puede ser superior a los 5 millones de euros<\/p>\n

– Actuar de buena fe. Se entiende que el deudor ha actuado de buena fe cuando el sobreendeudamiento no ha sido voluntario y ha intentado previamente acuerdos extrajudiciales con los acreedores<\/p>\n

– No haber acudido al mecanismo de la Segunda Oportunidad en los 10 a\u00f1os anteriores a la solicitud<\/p>\n

– No haber sido condenado por delitos econ\u00f3micos (estafa, levantamiento de bienes, etc.) o de falsedad documental en los diez a\u00f1os previos a la presentaci\u00f3n<\/p>\n

 <\/p>\n

\u00bfCu\u00e1les son las fases del proceso?<\/strong><\/p>\n

Las fases del procedimiento son:<\/p>\n

 <\/p>\n

\u2776 Acuerdo extrajudicial de pagos.<\/u><\/p>\n

El deudor inicia una negociaci\u00f3n con los acreedores para intentar pactar con ellos el pago de las deudas seg\u00fan su capacidad de pago.<\/p>\n

La negociaci\u00f3n se inicia con la presentaci\u00f3n de la propuesta de pagos ante el Notario junto con toda la documentaci\u00f3n relativa a bienes, deudas e ingresos. El Notario designar\u00e1 a un mediador concursal, que es quien trasladar\u00e1 la propuesta de pago a los acreedores.<\/p>\n

Si los acreedores aceptan el plan de pagos, la negociaci\u00f3n finalizar\u00e1 con \u00e9xito, con un Acta de acuerdo de pagos y su cumplimiento.<\/p>\n

Si no se consigue un acuerdo con los acreedores, se inicia la v\u00eda judicial.<\/p>\n

 <\/p>\n

\u2777 Concurso de acreedores<\/u>.<\/p>\n

Es la fase judicial. Desde el inicio del procedimiento se paralizan los embargos.<\/p>\n

 <\/p>\n

\u2778 Fase de liquidaci\u00f3n<\/u>.<\/p>\n

Se liquida todo el patrimonio del deudor (si existe), a excepci\u00f3n de los bienes necesarios como, por ejemplo, la vivienda habitual, y con todo lo que se obtiene de la venta de los bienes se pagan las deudas.<\/p>\n

\u2779 Solicitud de la exoneraci\u00f3n de las deudas<\/u>.<\/p>\n

Si no existe patrimonio, o de la venta de los bienes resulta una cantidad insuficiente para pagar a los acreedores, el deudor solicita al Juez que tramita el concurso de acreedores que le perdone o exonere las deudas restantes.<\/p>\n
