{"id":502,"date":"2021-09-26T16:33:32","date_gmt":"2021-09-26T16:33:32","guid":{"rendered":"https:\/\/www.aregaymartin.cat\/?p=502"},"modified":"2021-09-26T16:33:32","modified_gmt":"2021-09-26T16:33:32","slug":"regimen-de-visitas-entre-abuelos-y-nietos","status":"publish","type":"post","link":"https:\/\/www.aregaymartin.cat\/index.php\/es\/2021\/09\/26\/regimen-de-visitas-entre-abuelos-y-nietos\/","title":{"rendered":"R\u00c9GIMEN DE VISITAS ENTRE ABUELOS Y NIETOS"},"content":{"rendered":"<p>No es infrecuente que los abuelos pierdan el contacto con sus nietos y tengan que recurrir a la justicia para poderlos ver interponiendo una <strong>demanda para conseguir que se les reconozca un r\u00e9gimen de visitas.<\/strong><\/p>\n<p>Esta situaci\u00f3n se puede dar por diferentes motivos, por ejemplo, debido a la muerte de un hijo o hija, los abuelos y el progenitor superviviente no tienen una buena relaci\u00f3n, cuando se produce una crisis de pareja o matrimonial y el r\u00e9gimen de visitas que tiene el progenitor no custodio no es suficiente para mantener la relaci\u00f3n entre los abuelos y los nietos, o bien cuando existe una mala relaci\u00f3n entre padres e hijos que supone una ruptura de las relaciones entre abuelos y nietos, etc.<\/p>\n<p>&nbsp;<\/p>\n<p>En todos estos casos, tanto el C\u00f3digo Civil estatal como el C\u00f3digo Civil de Catalu\u00f1a reconocen el derecho de los abuelos a tener un r\u00e9gimen de visitas, incluso en contra de la voluntad de los progenitores, para <strong>proteger la relaci\u00f3n familiar.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>En este sentido, el <strong>art. 160.2 del C\u00f3digo Civil estatal<\/strong> recoge lo siguiente:<\/p>\n<p><em>\u201cNo podr\u00e1n impedirse sin justa causa las relaciones personales del menor con sus hermanos, abuelos y otros parientes y allegados.\u201d<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p>Y el <strong>art. 236-4.2 del C\u00f3digo Civil de Catalu\u00f1a:<\/strong><\/p>\n<p><em>\u00a0<\/em><em>\u201cLos hijos tienen derecho a relacionarse con los abuelos, hermanos y dem\u00e1s personas pr\u00f3ximas, y todos estos tienen tambi\u00e9n el derecho de relacionarse con los hijos. Los progenitores deben facilitar estas relaciones y solo pueden impedirlas si existe una justa causa.\u201d<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p>Por tanto, <strong>solamente se podr\u00e1 impedir la relaci\u00f3n entre abuelos y nietos si existe una justa causa<\/strong>, que tendr\u00e1 que ser alegada por los progenitores ante el Juzgado, y el Juez tendr\u00e1 que valorar si es motivo suficiente para negar o no esa relaci\u00f3n. Por ejemplo, un motivo por el que se podr\u00eda denegar el r\u00e9gimen de visitas es si la relaci\u00f3n con los abuelos perjudicara la salud f\u00edsica y mental de los menores.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>El r\u00e9gimen de visitas se determinar\u00e1 de acuerdo a las circunstancias personales de las partes.<\/strong> Algunos criterios que puede valorar el Juez son:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>La edad del menor (no puede ser el mismo r\u00e9gimen de visitas para un menor de 1 a\u00f1o que, por ejemplo, uno de 14)<\/li>\n<li>La relaci\u00f3n de los nietos con sus abuelos antes de la privaci\u00f3n de la relaci\u00f3n<\/li>\n<li>Si los nietos han pernoctado fuera de casa o no<\/li>\n<li>Si los padres est\u00e1n separados o divorciados, se tendr\u00e1 en cuenta el r\u00e9gimen de visitas del progenitor no custodio<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>De esta manera, nos podemos encontrar con <strong>diferentes reg\u00edmenes de visitas:<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li>Un fin de semana al mes y alg\u00fan d\u00eda durante las vacaciones de Navidad, Semana Santa y verano<\/li>\n<li>Un fin de semana al mes y alguna visita entre semana<\/li>\n<li>Solamente unas horas, una vez a la semana, cada quince d\u00edas o al mes<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Tambi\u00e9n se puede adoptar un r\u00e9gimen progresivo, es decir, se comienza con contactos cortos y se van ampliando conforme se consolida la relaci\u00f3n.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>No es infrecuente que los abuelos pierdan el contacto con  [&#8230;]<\/p>\n","protected":false},"author":3,"featured_media":503,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[36],"tags":[196,200,194,198],"class_list":["post-502","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-actualidad-juridica","tag-derechos-abuelos","tag-impedimentos-ver-nietos","tag-regimen-visitas","tag-relacion-nietos"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v24.7 -
