C\u00d3MO ACTUAR."},"content":{"rendered":"<p>En los procesos de familia la sustracci\u00f3n internacional de menores, si bien no es un delito habitual, puede llegar a darse en procesos de divorcio con un nivel de conflictividad muy elevado, o cuando los progenitores son de distintas nacionalidades y uno de ellos desea volver a su pa\u00eds. Tambi\u00e9n puede producirse entre matrimonios ya divorciados o parejas que ya cuentan con una sentencia.<\/p>\n<p>La sustracci\u00f3n internacional de menores se produce en los siguientes supuestos (art. 225 bis C\u00f3digo Penal):<\/p>\n<p>&#8211; <u>Desplazamiento:<\/u> cuando uno de los progenitores se traslada permanentemente a un pa\u00eds distinto de aquel en el que el menor resid\u00eda habitualmente, tomando la decisi\u00f3n unilateralmente, sin contar con el consentimiento del otro progenitor.<\/p>\n<p>&#8211; <u>Retenci\u00f3n:<\/u> cuando uno de los progenitores se traslada a otro pa\u00eds, impidiendo as\u00ed que el otro progenitor pueda ejercitar su derecho de visitas.<\/p>\n<p>Si se produce una de estas situaciones, debe actuarse con rapidez, realizando las siguientes actuaciones:<\/p>\n<ul>\n<li>Interponer <strong>DENUNCIA<\/strong> ante una dependencia de las Fuerzas y Cuerpos de Seguridad del Estado competentes por una presunta perpetraci\u00f3n de un delito de sustracci\u00f3n de menores previsto en el art. 225 bis del C\u00f3digo Penal.<\/li>\n<li><strong>SOLICITUD DE RESTITUCI\u00d3N<\/strong> del menor ante el Ministerio de Justicia, si el pa\u00eds en el que se encuentra el menor es un estado miembro de la Uni\u00f3n Europea o cualquiera de los pa\u00edses firmantes del Convenio de La Conferencia de La Haya de 25 de octubre de 1980 sobre los Aspectos Civiles de la Sustracci\u00f3n Internacional de Menores.<\/li>\n<\/ul>\n<p>Si el pa\u00eds en el que se encuentra el menor no es un pa\u00eds firmante del Convenio de la Haya debe ponerse en conocimiento del Ministerio de Asuntos Exteriores y de Cooperaci\u00f3n que informar\u00e1 a la Embajada o Consulado de Espa\u00f1a correspondiente.<\/p>\n<p>La solicitud debe presentarse antes del plazo de un a\u00f1o ya que, transcurrido ese plazo, se puede alegar la integraci\u00f3n del menor en su nuevo domicilio.<\/p>\n<p>El procedimiento judicial de restituci\u00f3n se llevar\u00e1 a cabo ante los tribunales del pa\u00eds en que se encuentre el menor.<\/p>\n<ul>\n<li>Solicitud de <strong>DECLARACI\u00d3N DE TRASLADO IL\u00cdCITO<\/strong> conforme dispone el art. 778 <em>sexties<\/em> de la Ley de Enjuiciamiento Civil.
